Terms & Conditions

These Terms & Conditions (“Terms”) are a binding agreement between you (“you,” “client,” “visitor”) and Yellow Wheels Art Inc., (Ontario Business Number 1001300703), the owner and operator of yellowwheelsart.ca. By accessing this website or booking our event-décor services you confirm that you have read, understood and agree to be bound by these Terms.

1. Who may use our site & services

You must be at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter contracts. If local laws prohibit balloon-gas cylinders or certain props at your venue, you may not order those items.

2. Key commercial terms

  • Quotes are valid for 14 days.

  • A 50 % non-refundable deposit secures the date; the balance is due on or before installation.

  • Prices shown on the site are CAD and may change without notice until you pay the deposit.

  • Mileage outside our 50 km service zone is billed at $1 /km.

  • Any venue fees (loading docks, elevator bookings, disposal charges) are your responsibility. 

3. Returns, reschedules & refunds

  • Deposits stay with us if you cancel.

  • Cancel or reschedule >14 days before the event → no extra fee; deposit moves to one new date within 90 days, subject to availability.

  • Cancel ≤14 days → full balance is payable.

  • If we cancel for a reason under our control, you get a full refund of amounts paid. 

4. Right to change the offering

We may add, remove or modify packages, props or prices at any time, or suspend the site for maintenance, without liability to you. Existing confirmed bookings are honoured.

5. Warranties & responsibilities

We warrant that décor will substantially match the approved mood-board at the time of installation. Latex balloons are perishable; oxidation and colour shift after setup are normal and not covered by warranty. If a balloon pops during install we replace it on-site at no charge. Beyond that, all services are provided “as-is.” 

6. Intellectual property

The website, photos, designs, logos (including the yellow-wheel bicycle mark) and any templates we supply remain our exclusive property. You may not copy, sell, or redistribute them without prior written consent.

7. Suspension or refusal of service

We may refuse or cancel a booking, or remove décor early, if the venue is unsafe, the client breaches venue rules, or payment terms are violated. No refunds are due in those circumstances.

8. Indemnification

You agree to indemnify and hold Yellow Wheels Art Inc., its owners and contractors harmless from any claims, damages, or expenses (including legal fees) arising from your misuse of the site, breach of these Terms, or damage to rented props while in your care. 

9. Limitation of liability

To the maximum extent permitted by Ontario law, our total liability for any claim relating to the services is limited to the amount you actually paid us for that booking. We are not liable for indirect or consequential losses, lost profits, or venue penalties.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged on the homepage. Continued use of the site or our services after a change constitutes acceptance of the new Terms. If you disagree, stop using the site and cancel any unfulfilled bookings in line with Section 3. 

11. Promotional e-mails & SMS

By entering your e-mail or phone in a quote or booking form, you consent to receive transactional messages plus occasional promos (max two per month). Opt out at any time via the unsubscribe link or by texting STOP. 

12. Governing law & dispute resolution

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute will be resolved exclusively in the courts of Toronto, Ontario.
